    A recent New York Timesarticle highlights what it calls a “tidal wave of business bankruptcies” that are coming due to financial fallout from the COVID-19 pandemic. A number of high profile businesses have already declared bankruptcy, including J.C. Penney, Hertz, J. Crew, Neiman Marcus, 24-Hour Fitness, Borden Dairy, and Pier 1 Imports.     The eyes of the financial world were on the U.S. during 2013. The view was dismaying and encouraging in roughly equal parts. The U.S. rang in the new year with a post-last-minute deal to avoid the Fiscal Cliff that kicked negotiations over "sequestration"—$110 billion in across-the-board cuts to military and domestic spending—two months down the road, but raised income taxes (on the wealthiest Americans) for the first time in two decades.

    When does the IRS have Priority in Bankruptcy?

    For creditors in bankruptcy proceedings, as with many things in life, priority is everything.  It is often the case that a person filing for bankruptcy has insufficient funds to pay in full all of his or her creditors.  As a result, creditors try to establish their priority so they are more likely to get paid before the money runs out.  Section 507 of the Bankruptcy Code provides rules explaining the order in which expenses and claims have priority in bankruptcy.  Notably, Section 507(a)(8) provides the IRS with priority treatment in bankruptcy with respect to claims for
